National Open 2008 G/10 Am I a victim, victor, or inmate?

Am I a Victim or Victor or inmate? What separates the terms victor, victim, and inmate? Hi my name is Rene’ Phillips United States Chess Federation Victim 11489052. I wished to share my experience from the National Open in Las Vegas this past weekend. I thought a brief mention of three terms would serve to help place readers in the milieu of the event amidst the sights and sounds consistent with the allure of Las Vegas. Many would argue that the words “victim”, “victor”, and “inmate” are completely unrelated. “Victory” is a term most people relate to a contest or debacle wherein winning, overcoming, subduing, persevering, and completing a task that ends with the desired result. While the term “victim” carries the connotation of an event where one or more people have been hurt, or wounded intentionally or unintentionally with no attempt of the aggressor and/or any other party present to make amends. Finally, an “inmate” is a person charged with a crime, deprived of many rights who then imprisoned pending trial.     During the National Open in Las Vegas this past week, I was allowed to experience both sides of the spectrum. I am playing GM Zviad Izoria in the second round of the G/10 championship. I have the White pieces and was able to reach a very familiar position of the London System. Izoria upon reaching an equal position and desiring to complicate things sacrificed a piece for two connected passed pawns. Upon returning the piece, I found myself with a special advantage and huge advantage in time. We both agreed to play without the increment as we could not set the function on the clock at the beginning of the game. Hence the digital display read 2 minutes for me and 10 seconds for Izoria.    A time scrambled ensued and the crowd gathered around this the last game of the round with an upset looming in the air. I notice there was a crowd of approximately thirty spectators pushing and jockeying for a better position from which to view the debacle. In the time scramble Izoria attacked my rook and in haste to move the rook, I inadvertently knocked my King down and grabbed the attacked rook. Upon releasing the rook and restoring my King to an upright position, Izoria with 2 seconds on the clock captured my rook and uttered “Touch move!” I see Izoria now has 1 second and thus with two pawns and no checkmate in site for either side, I shun summoning the tournament director for the inadvertent King touch and announce “Flag”!    GM Izoria at this time uttered something in his native tongue and stopped the clock. The digital display showed 12 seconds for me and no time for him. At this juncture, a woman wearing a burgundy tournament director’s shirt intervened without being summoned by either player and stated the game was a draw. The woman TD was later identified as Betsy. Betsy advised that she would place one second on Izoria’s clock and then the game can be officially drawn. I inquired as to the basis of the draw and Izoria answered for the TD and said because I am up a rook and I would win with more time. The tournament director Betsy picked up the clock as more people gathered around. She places the one second on the clock and says now the game is a draw.     I am immediately rushed by several spectators as I proceed to the pairing table in an attempt to get a second ruling from another TD. Upon arriving at the pairing table along with several other players, we were met sternly by TD Walter Brown. I politely inquired if I could speak with another tournament director about a ruling just rendered, and without hearing my story, Brown yelled rudely; “Whatever the tournament director said is final. Now we have work to do and you have to get out of here! I attempted to diffuse the situation by talking calmer, but was met by even more stiff verbal humiliation. Another director with a long white beard chimed in on cue and yelled, “What is it that you want?!     At this time TD Walter Brown advised that he would call security and have me thrown out if I didn’t leave. Seeing a ride to jail was inevitable if I continued to attempt to reach resolve with the outraged and angered TDs, I exited the room and proceeded to the tournament registration table. I requested to speak with a senior director or an executive level administrator with the tournament staff and was advised that Mr. Bob Snead was not available, but upon being given my name and brief details of my issue, would get back to me.     I forwarded my name, brief details of the incident and started back toward the tournament room. Prior to reaching the tournament room, I was met outside by TD Walter Brown who related that he had just been made abreast of the incident and he stated; “I just heard what happened and I think you got ripped off badly. I will return your entry fee in exchange for your inconvenience. I returned to the game room only to find out the third round had started and I had been paired against a women’s IM and she had started my clock. Approximately five minutes had elapsed in the G/10 game, but I knew going back the same directors who were infuriated by me inquiring about the previous game would me met with swift and quick verbal humiliation.    In spite of my anger and feeling of helplessness I won the game against the WIM. I however could not shake the feeling of being cheated and victimized. I won the game and was not declared the victor, but was victimized by the player, the tournament directors and the GMs, IMs, FMs, and other rated players present who witnessed this travesty and said nothing on my behalf to the tournament directors. Throughout the remainder of the National open I was asked by scores of players, coaches, and other tournament directors about the incident. I retold this story at least 20 times to different directors who all stated that I should have summoned another director (which I made several attempts) and ask for a second opinion.     Notwithstanding, after the numerous futile attempts at getting some type of meaningful resolve I talked one last time to Bob Snead who related that I would get my entry fee returned, but I should have made an attempt to contact another tournament director on the day of the incident. (Billy Preston’s “Going to go round in Circles” painfully comes to mind.) Thus here I stand several days later, feeling not like a victor, but a victim, and much worse a victim who has no recourse. Here it is I have returned home and still feel helpless with no returned entry fee, a crosstable from the G/10 that reflects a draw against GM Zviad Izoria in round two despite me winning the game on time. More importantly as a retired policeman whose job was to protect and serve, despite receiving an award from Janet Reno as America’s top cop in 1997, I was treated like a criminal by the National Open rulings or lack of proper rulings and United States Chess Federation and as a victim have no recourse. Inmates lose very many rights after they are sentenced for crimes, but even after being found guilty of the most heinous of crimes, they retain the right to appeal. wow that has to be one of the dumbest comments i've ever heard! i'm sure he was robbed because he's black! just like obama didn't win the presidency because he was...... wait he won right??? i'm sure they wanted a all white final! had nothing to do with rules, this that and the other thing, out to get ya even in chess.

Well you seem to covered the bases as to appeals. I was a bit upset with the issue of race being a factor in all of this.Unfortunately the world in which we live is full of ignorance and hate for our fellow human beings. Racial and Religious tensions have been with us for centuries. We seem to forget history and why millions were slaughtered in wars. We seem to take our freedom for granted. The cost of our heritage is high. I was in the VA hosp for a year and met allot of injured young men my sons age. I was told of ethnic cleansing of Bosnians by Serbs , Shites against Sunnies,Muslims against Jews, about being hated and tortured because we pray differently. The list is endless. I guess the USCF is just like everyone else.

I am returning to college to finish a degree in History. I will teach High School history somewhere. I will get my views across about why the world is near FUBAR. I got a short fuse on racism of any kind. The main thing we must do is teach our students is that it is the most stupid thing humans all seem to have in common! We can`t cure it but we sure as heck can get our point across that it stupid and wrong and check it at the door before entering the class. Kids today have enough problems. They look to us on how to deal with adversity. No matter how we feel , they need a role model on ethics that they may not get at home. Remember that knowledge is the key, figure the problem and sort it out.

I would like to sort out those snakes in the USCF. They have some major problems in management to , as You are aware of.How do you think Miss.Krush felt as her opponent held her clock button down and made moves on her time , while the knucklehead TD stood by and laughed!? She lost more than an entry fee! Make it a teaching tool to why your students should read the rules. I tell mine to stop the clock and get the TD and let him do his job , hopefully! Turn the negative into a positive.

Hey Scott, thanks Bro for the encouragement. The thing that hurts me more than anything above being robbed of the game is that I have filed, written to the USCF, called, talked, taped, dvdeed, and cdeed and not as much as gotten a response from anyone at the USCF. I guess since I am a person of color despite having paid thousands of dollars to the USCF in dues, registrations, membership fees, not to mention the thousands of dollars I have brought to the USCF through hundreds of students over a 20 +  year period, because I am a person of color, I am not a person as far as the USCF is concerned. Needless to say I would rather have all my US students join the Canadian or some other chess federation other than the USCF. How sad that the rest of the world lives in 2008 and the USCF is still in the 1800's as it relates to African Americans.

Just read this old post of yours. I would have been taken to jail and Tasered during the struggle! I would have charged reverse discrimination!! I have some Scottish blood lines , along with a bevy of other doubtful lineage's! But , joking aside about ancestry , you was robbed Bro! I was not there but some rules were not followed and remember that the Titled players are treated normally with preference by TDs. Plus , lets face it Rene , you are of color and you would scare the bejesus out of any sane TD just by your presence alone. I would not want you upset at me and I scare people to! They played the old " You are mean and unruly trick ", before you had the chance to protest properly! Works every time. I know you are a gentleman and a class act. I suggest what some others have already that you send an official protest to the USCF rules&ethics board , and take it like a man. Remember Bro that you are a professional Chess player now and expect no quarter from players or TDs. Knowledge is your weapon of choice. Arm yourself to the max! Know the book of laws , USCF&FIDE! Next time you hit the strip for the big money tourney's, stop by the TDs table and introduce yourself and get re-certified as a TD! Your to smart to be a victim!!

 well i have found myself sometimes not to have known rules and it has costed me games. I want to believe that this is not personal, but i know things are sometimes. cool mo dee said knowledge is king, but anger sometimes ruins everything, and we all know people don,t like to get involved in hot issues. I will not claim to know all the rules, but most td don,t either and they are human. I hope you learned something and i hope the td,s got together and learned something also and everybody does a better job next time.  I,ve had the pleasure of playing in many uscf tournaments and i have been very happy overall, so keep playing and when you learn something make it a positive and teach others how not to get in this situation if possible.  I,ve met with many chess players and you know that they are human and some are very nice all the time and others can be snotty and somewhat arrogant at times. Your a very good player and i hope you will be in that same tournament again.

You are a Victor but you should refuse to be a Victim. You may write your case to chess authorities, chess-related media, forums, etc. Be a crusader by expanding the issue, not limited to the particular experience but also to the unfairness and discrimination. At least, if they don't give you back that particular win, it should serve as a deterrent to similar situations in the future.

Perhaps, just perhaps this is not the whole story.  My experience in disputes is that 1) there are always at least 2 sides, and 2) generally one of the participants in the dispute is rarely the most objective source of what happened. So I don't assume that the post reflects what actually happened. Not saying it doesn't, but the comments all seem to assume that this is the gospel truth as to what occurred.

Thanks for your comment my friend, but I feel like I am spinning my wheels and the lack of any justice on this wise has done no more than add frustration to my life. Many have encouraged me to move on as the matter only looms larger to me and since nothing has or will be done about it, why raise my blood pressure? Thanks Snits, but every attempt I have made to resolve this issue by dialoging with someone from the USCF, has been futile. Sad.

You should file a complaint with the TDCC and get whoever made the ruling stripped of her TD certification. Maybe posting a thread on the forums at uschess.org might also get some responses on what you should do.

Were they trying to use the rule for insufficient losing chances because no increment/delay was being used on the clock? Even if that is the case, I believe the player has to call it prior to flagging, not the TD.

I am fully aware of the USCF rules regarding play, moves, etc. Hence the reason for the article in the first place. I had two pawns left and didn't protest the inadvertant touch of the King because my opponent had two seconds left. I had two pawns when the smoke cleared which constitutes "mating material". Thanks for the comments and writing guys, the painful part of the entire experience is that in addition to being robbed, humiliated and talked down too for inquiring as to the basis of the draw, I was threatened with being removed from the tournament. Additionally, I was told in response to what one tournament director stated "was a robbery decision", and that my entry fee would be returned, nothing has nor will happen.

Touch move is a well-known rule and always enforced at USCF-rated events.

As I said above, "If you inadvertenly touch a piece, of course you do not have to move it. But you didn't protest or summon a TD at that moment, and you cannot delay such a dispute, so by the rules the capture of your rook would stand." TheChessGym said he didn't summon a TD because he thought he was about to win on time.

The original poster has not clarified why he drew instead of winning on time. My guess is 14E, "Insufficient Material to Win on Time". But, the TDs are not allowed to make that claim for players--TD Betty made a big and unfair mistake by doing that.

Chess player, I also must ask, Is touch move a standard setting with such venues as

In Vegas ?

If so, Let the player beware.. Caveat Persona !!! If not call a cop !!! Wait you are one ok, retired !!

More impressive is Your over coming 5 mins down vs. a women’s IM . To be reeling from your hand slip / draw /dogmatic tournament director’s officiating ..
